US TERMS AND CONDITIONS
1. ENTIRE AGREEMENT
1.1. For the business relationship between TOURNEAU, LLC. d/b/a Bucherer USA, 663 Fifth Avenue, New York, NY 10022, (hereinafter referred to as “Seller”) and the Customer (hereinafter referred to as “Customer”) for transactions on the Bucherer USA website (https://www.bucherer.com/us/en) (hereinafter referred to as “Website”), these General Terms and Conditions (hereinafter “GTCs”) shall apply in the version posted at the time the order is placed. These GTCs govern all purchases made through the Website and supersede any conflicting or additional terms proposed by the Customer unless expressly agreed to in writing by Seller. Seller reserves the right to modify these General Terms and Conditions at any time without prior notice.
1.2. The Customer may fully access the General Terms and Conditions on the Website. To obtain a printed version please visit the nearest Bucherer USA store or contact Customer Service pursuant to the information provided herein.
1.3. Use of the Website is intended for Customers 18 years of age and older, residing in the United States. Seller shall only accept Orders for and ship products to valid delivery addresses located within the fifty (50) United States and the District of Columbia. Products sold on the Website are intended for personal, non-commercial use only. Purchasing items for commercial purposes, including but not limited to resale, distribution, or unauthorized retail matching, is strictly prohibited. We reserve the right to cancel any Orders that we suspect violate this policy.

3. ORDERS AND ACCEPTANCE
3.1. Products displayed on the Website constitute an invitation to the Customer to submit an Order and are not binding offers to sell.
3.2. Once Customer enters all online required data and acknowledges these GTCs and clicks “Place Binding Order” (“Order”), Customer submits an offer to purchase the selected products subject to these GTCs. Until this process is completed, the Customer can select products from the Seller’s assortment without commitment and place various products in the shopping cart via the “Add to Cart” button. Before placing the Order, the Customer can enter and change the Order information.
3.3. After placing an Order, the Customer will receive an automated Order confirmation via e-mail containing the details of the Order. This email does not constitute acceptance of the Order.
3.4 Eligible products may also be purchased online and picked up at participating Bucherer retail locations ("Click & Collect Service"). Government-issued identification and proof of purchase are required for pickup. Customer will receive an email confirmation when the Order is ready for pickup and the relevant store will contact the customer to arrange collection. Please allow 2-3 business days from receipt of the Order confirmation for processing. Orders not retrieved within thirty (30) days of notice may be canceled and refunded to the original form of payment.
3.5 The Seller reserves the right, in its sole discretion, to refuse or cancel any Order for any lawful reason, including suspected fraud, suspected unauthorized resale activity, prior payment issues, inventory errors, or excessive returns activity.
3.6 A binding contract is formed only when Seller sends a shipment confirmation, pickup confirmation, or other written notice expressly accepting the Order.
3.7 If payment is processed before acceptance of an order and Seller later declines or cancels the Order, Customer will receive a refund for the applicable amount.
3.8 If an Order contains multiple items, Seller may accept some items and decline others. Customer will only be charged for accepted items.
3.9 At any point, the registered Customer can view the status of the Order in the “Account” section of the Website.
4. PRICES, SHIPPING AND DELIVERY
4.1 All prices displayed on the Website are in U.S. dollars and exclude applicable sales tax unless otherwise stated. All applicable charges including sales tax and shipping charges will be calculated at checkout prior to submitting the Order.
4.2 The Seller reserves the right to change pricing at any time prior to Order placement.
4.3 Unless otherwise agreed (i.e. Click & Collect Service, see section 3.4), delivery shall be made to the address and recipient provided in the Order.
4.4 Once an Order ships, Customer will receive a shipment confirmation email with tracking information.
4.5 Upon receipt of the shipment confirmation e-mail Customer must promptly contact Customer Service for any change requests or cancellations, subject to section 6 below.
4.6 Seller only ships within the Continental United States, Alaska, Hawaii and Puerto Rico. Unless otherwise stated, the standard delivery time is 1 to 2 business days (excluding weekends and select holidays) from receipt of the shipment confirmation. Estimated delivery dates are provided for convenience only and are not guaranteed.
4.7 Customer must promptly notify Seller of any lost, delayed, damaged, or incomplete shipments by contacting Customer Service.
4.8 Seller shall not be liable for delays or failure to perform caused by third parties or events beyond its reasonable control, including supply shortages, transportation disruptions, labor disputes, natural disasters, or other force majeure events, .In such event, Seller shall inform the Customer immediately and, if applicable, indicate the new anticipated delivery deadline. If the new delivery date is not acceptable to the Customer, or if the Products are partially or no longer available within the new delivery date, the Seller shall immediately refund the Customer for any amounts paid, to the to the original form of payment.
5. PRESENTATION OF PRODUCTS AND AVAILABILITY
5.1. Product images and descriptions are provided for informational purposes only and may minimally vary from the actual product, excluding manufacturer provided information and stated specifications. Images of CPO watches are individual and directly represent the available watch. All products are subject to availability. Seller reserves the right to discontinue the offering of products or limit quantities at any time without notice.
5.2. Where specifically indicated certain products depicted on the Website cannot be ordered and purchased directly via the Website. For these products, a request form is provided to the Customer, accessible on the Website.
5.3 Seller shall not be liable for delays or failure to perform caused by third parties or events beyond its reasonable control, including supply shortages, transportation disruptions, labor disputes, natural disasters, or other force majeure events. In such event, Seller shall inform the Customer immediately and, if applicable, indicate the new anticipated delivery deadline. If the new delivery date is not acceptable to the Customer, or if the products are partially or no longer available within the new delivery date, the Seller shall immediately refund the Customer for any amounts paid, to the original form of payment.
6. RETURN POLICY
6.1 Eligible products may be returned within fourteen (14) calendar days after delivery or in-store (Click-and-Collect) pickup. The return must be processed online, either via the Customer's Bucherer account or at https://www.bucherer.com/us/en/services/returns, or by contacting Customer Service.
6.2 Items that are eligible for return must be unused, unaltered and in original condition, accompanied by original packaging (including labels, protective seals, film or similar), accessories, and documentation. Customized, engraved, altered, modified, or otherwise personalized items are non-returnable.
6.3 CPO watches that are eligible for return must match the exact condition according to the description and photo documentation at the time of purchase or shipment. If the return shipment does not meet these requirements, then Seller may reject the return at its sole discretion.
6.4 Seller reserves the right to deny refunds for returned products showing signs of wear, damage, alteration, or missing components, or does not meet the stated return requirements.
6.5 The Seller bears the costs of returning the products if the Customer uses the return label provided by the Seller. If the Customer does not use the pre-paid return label, then the Customer is liable for the insurance and full value of the returned Products, and the Seller is not responsible for loss, damage, shipping to an incorrect address or for delays in delivery of the return shipment.
6.6. Refunds are made via the same payment method that the Customer used when ordering, unless something else is expressly agreed with the Customer. The refund takes place only after the returned Goods have been received by the Seller and subjected to a quality inspection.
7. PAYMENT METHODS
7.1 For orders on the Website, the Customer may use the payment methods specified therein. For further information, please refer to Payment.
8. RISK OF LOSS
8.1. Risk of loss and title, transfer to Customer upon carrier’s delivery of the products to Customer or, for Click & Collect orders, upon pickup by Customer.
9. INSPECTION AND WARRANTY CLAIMS
9.1 Commercial or technically unavoidable, material-related deviations of the quality, color, size, equipment or design of the products do not constitute a defect. This also applies to documented and disclosed potential signs of aging on CPO watches.
9.2 Customer should inspect all delivered products promptly upon receipt and to immediately inform Customer Service of any defects detected. If the Customer fails to notify Seller of any alleged defects within eight (8) days after delivery, the products are considered approved.
9.3 Before returning the products and upon notifying Seller of the defect, the Customer must contact Customer Service to direct how to proceed. The defective products can only be returned after this notification. The delivery costs incurred for any return shipment will be borne by Seller provided the direction for the return by Customer Service is adhered to.
9.4 In the event of a defect of a product subject to a warranty, the Seller may remedy the defect, at its discretion, by repairing the product or replacing the product. In the event the repair or replacement is not possible, then Seller will provide a refund of the purchase price. Regarding a detected defect in any CPO watch, Seller’s remedy is the repair of the defect. If the repair is impossible, then seller will provide a refund of the purchase price.
9.5 Warranty coverage does not apply to normal wear and tear; misuse; unauthorized repairs or modifications, improper storage or handling, or damage caused by accidents or external event, A warranty for normal wear, consumables, accessories and for included batteries is excluded.
9.6 The Customer receives no guarantees within the meaning of the law, except any manufacturer’s warranty (or, in the case of CPO watches, the specific CPO warranty provisions, see here). The Seller assumes no liability for the descriptions of third parties, in particular other Customers in the context of the Customer evaluations published on the Website or our social media presentations.
10. SHIPPING DAMAGE
10.1 If products are delivered with obvious transport damage, then the Customer must report such defects immediately to the Seller. Failure to promptly file a complaint or make contact has no consequences for the legal claims and their enforcement, in particular the warranty rights (see, however, the obligation regarding timely notification of defects in clause 9.2 and 9.3). However, the Customer shall help the Seller to assert its own claims against the freight carrier or transport insurance.
11. LIABILITY
11.1. The liability of the Seller for slight negligence is excluded. The liability for auxiliary persons is completely waived.
11.2. In particular, the Seller shall not be liable for damages that are attributable to one of the following causes: (i) improper, contrary to the contract, or unlawful storage, configuration or use of the products, (ii) use of incompatible replacement or accessory parts, (iii) omitted maintenance and/or replacement parts, (iii) omitted maintenance and/or improper modification or repair of the products, by the Customer or a third party, (iv) force majeure, in particular damage from the elements, moisture, fall and impact etc., for which the Seller is not responsible, and official orders.
12. LIMITATION OF LIABILITY
2.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SELLER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR BUSINESS INTERRUPTION.
SELLER’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO ANY PRODUCT OR ORDER SHALL NOT EXCEED THE PURCHASE PRICE PAID FOR THE APPLICABLE PRODUCT.
12.2 Nothing in these GTCs limits liability that cannot be excluded under applicable law, including liability for personal injury, fraud, or gross negligence where prohibited
13. DATA PROTECTION
Seller’s collection and use of personal information are governed by Seller’s Privacy Policy.
15. APPLICABLE LAW AND PLACE OF JURISDICTION
14.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.
14.2 Any dispute arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in New York County, New York.
