GENERAL TERMS & CONDITIONS FOR THE PURCHASE OF PRE-OWNED WATCHES

These General Terms and Conditions (“Terms”) govern all transactions in which Bucherer USA (“Bucherer”) purchases pre-owned watches from private individuals (“Seller”). These Terms apply to both the online submission or the in-person sale at a Bucherer location of pre-owned watches, and any related inspection, acceptance, or payment process for each.
1. Definitions
For purposes of these Terms, “Watches” means pre-owned watches, including all associated accessories and materials provided by the Seller, such as boxes, warranty cards, certificates, proof of purchase, additional straps, service records, or similar items. “Online Purchase Process” means the process by which the Seller submits information electronically, sends the Watch to Bucherer, and communicates with Bucherer through online channels, email, or telephone. “Offline Purchase Process” means the process by which the Seller delivers the Watch and completes the sale in person at a Bucherer retail location. “Buy-In” means payment of the agreed purchase price by Bucherer to the Seller by check or electronic transfer. “Trade-In” means payment by Bucherer in the form of a store credit or voucher, which may be available only in an in-store transaction, subject to Bucherer’s policies.
2. Scope of Application and Contractual Relationship
These Terms apply to all purchases of Watches by Bucherer USA from individual consumers located in the United States who are legally permitted to sell personal property. Sales by commercial sellers or dealers are excluded unless expressly agreed in writing. No other terms proposed by the Seller apply unless Bucherer expressly accepts them in writing. If Bucherer requires that a transaction be completed in-store due to the value of the Watch or for verification reasons, Bucherer may designate an offline purchase process, in which case the Seller may choose to proceed in-store or discontinue the transaction without penalty.
3. Valuation Request and Seller’s Offer
To receive an initial estimate, the Seller must provide accurate and complete information about the Watch, including brand, model, condition, serial number, and images, as well as the Seller’s contact information. Based on this information, Bucherer may provide a non-binding estimate and invite the Seller to submit an offer to sell the Watch. The estimate is an invitation to make an offer and does not constitute a purchase agreement. By accepting the estimate within the stated time period and submitting the Watch, the Seller makes a binding offer to sell the Watch to Bucherer at the estimated price and under these Terms. If the Seller does not respond within the stated period, the estimate expires automatically.
4. Shipment and Receipt of Watches
If Bucherer agrees to review the Watch, Bucherer will provide shipping instructions. The Seller is responsible for properly packaging the Watch to withstand ordinary transportation risks. Bucherer will select the carrier and provide insurance coverage only if the Seller follows Bucherer’s shipping instructions and uses the designated carrier. Bucherer is not responsible for damage caused by improper packaging. Upon receipt, Bucherer may document the unboxing and will notify the Seller that the Watch has arrived and will be inspected within a reasonable period.
5. Inspection and Acceptance
Bucherer will inspect the Watch to verify authenticity, condition, and ownership. Bucherer may request additional information or documentation from the Seller during this process. Following inspection, Bucherer will either accept or reject the Seller’s offer. If Bucherer rejects the offer, Bucherer will notify the Seller and return the Watch at Bucherer’s expense, unless the Seller provided inaccurate information or the Watch’s authenticity is in question, in which case the Seller may be responsible for return costs. If Bucherer accepts the offer, Bucherer will notify the Seller, and a binding purchase agreement will be provided.
6. Payment and Completion of Sale
Upon acceptance of the Seller’s offer and subject to completion of verification requirements, Bucherer will pay the agreed purchase price to the Seller within a reasonable time using the agreed payment method. Payment does not waive any rights Bucherer may have if subsequent information reveals misrepresentation or lack of ownership.
7. Authenticity, Counterfeit and Stolen Watches
By submitting an offer, the Seller represents that the Watch is authentic, contains only original manufacturer components unless disclosed and accepted by Bucherer, and is not stolen. If Bucherer reasonably determines that the Watch is counterfeit, altered, or stolen, Bucherer may document the findings, refer the Watch to the manufacturer, and notify law enforcement or comply with any legal request to surrender the Watch. If a Watch is seized by authorities or retained by a manufacturer, Bucherer will have no further responsibility for it and will inform the Seller to the extent permitted by law.
8. Ownership and Title
The Seller represents that the Seller is the sole lawful owner of the Watch and that the Watch is free of liens, financing arrangements, or third-party claims and has not been reported lost or stolen. Ownership transfers to Bucherer only after Bucherer has accepted the Watch and paid the purchase price. If it is later determined that the Seller did not have lawful title, Bucherer may rescind the transaction and pursue all available remedies.
9. Verification of Ownership and Identity
The Seller agrees to provide all information and documentation reasonably requested by Bucherer to verify ownership, authenticity, and lawful origin of the Watch. The Seller authorizes Bucherer to verify such information with manufacturers, retailers, law enforcement, or other third parties and to provide Seller information to authorities where required or permitted by law. Bucherer may require government-issued identification before completing the transaction.
10. Customs Compliance
The Seller represents that the Watch has been properly imported into the United States and that all applicable duties and taxes have been paid. Bucherer may request documentation confirming lawful importation and tax compliance.
11. Warranties, Indemnification, and Liability
The Seller provides no warranty regarding the Watch other than warranties of ownership, authenticity, and lawful importation. The Seller agrees to indemnify and hold Bucherer harmless from any claims arising from breach of these representations. Bucherer’s liability is limited to damages caused by intentional misconduct or gross negligence. Bucherer is not liable for indirect or consequential damages except where liability cannot be limited under applicable law.
12. Personal Information
Bucherer collects and uses personal information to process service requests, communicate with you, perform Services, process payments, return Items and comply with applicable laws. Personal information will not be sold or shared except as required by law or with service providers assisting in the transaction. Buyer complies with applicable U.S. privacy laws, including the CCPA and applicable U.S. privacy laws, and Bucherer’s Privacy Policy.

13. Governing Law and Venue
These Terms and any related transaction are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any legal action must be brought exclusively in the state or federal courts located in New York County, New York.
14. Final Provisions
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
